These Terms of Service (“Terms”) govern your access to and use of vewtopia.com (the “Site”), operated by VewTopia (“we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Overview and acceptance of terms

VewTopia is an independent editorial travel-planning platform for music festivals and concert weekends. We publish guides, curated recommendations, and links to third-party services. We do not sell tickets, accommodations, rentals, or products directly. All purchases occur through our affiliate partners and are subject to their own terms, conditions, and policies.

By using the Site you represent that you are at least 13 years of age (or the minimum age of digital consent in your jurisdiction) and that you have the legal capacity to enter into these Terms. If you use the Site on behalf of an organization, you represent that you are authorized to bind that organization.

2. User accounts

Account creation

• Account creation is optional for browsing, but required for certain features such as AI-powered tools and saved preferences.
• You must provide accurate, current, and complete information when creating an account and keep it updated.
• You are responsible for safeguarding your password and for all activity that occurs under your account.
• You agree to notify us immediately of any unauthorized use of your account or any other security breach.

Account responsibilities

• You may not share your account credentials with others or allow concurrent logins from unrelated parties.
• One person or entity may not maintain multiple accounts for the purpose of circumventing limits or restrictions.
• We may suspend or terminate accounts that violate these Terms or that we believe are engaged in fraudulent or abusive activity.
• You are responsible for all content you submit and for ensuring it does not violate any third-party rights.

3. Festival, concert, and travel bookings

VewTopia displays event, hotel, experience, and car rental information sourced from third-party partners. We do not process bookings or take payment for these services. When you click through to a partner, your transaction is governed by that partner’s terms, cancellation policy, and refund policy — not these Terms.

• Ticketmaster: Ticket availability, pricing, fees, delivery, cancellations, exchanges, and refunds are governed by Ticketmaster’s purchase policy and the event organizer’s rules.
• Expedia: Hotel and accommodation bookings, modifications, cancellations, and refunds are governed by Expedia’s terms and the individual property’s cancellation policy.
• Viator: Experience and activity bookings, availability, and cancellation terms are governed by Viator’s booking conditions and each operator’s policy.
• DiscoverCars: Car rental bookings, insurance, deposits, and cancellation terms are governed by DiscoverCars’ terms and the rental supplier’s conditions.

We strive to display accurate event dates, prices, and availability, but third-party information may change without notice. Always confirm details on the partner’s site before completing a purchase. VewTopia is not liable for errors, omissions, or changes in third-party listings.

4. Affiliate partnerships and compensation

VewTopia is an affiliate publisher. We earn commissions or referral fees when you click certain links and complete qualifying actions on partner sites. This compensation does not influence our editorial recommendations, and we disclose our affiliate relationships in accordance with FTC guidelines. • Amazon Associates: As an Amazon Associate we earn from qualifying purchases. Amazon sets cookies on your browser when you click through, and the Amazon Conditions of Use govern your purchase.
• Ticketmaster Affiliate: We may earn a commission on ticket purchases referred from VewTopia.
• Expedia Affiliate: We may earn a commission on hotel and accommodation bookings referred from VewTopia.
• Viator Affiliate: We may earn a commission on experience bookings referred from VewTopia.
• DiscoverCars Affiliate: We may earn a commission on car rental bookings referred from VewTopia.

Affiliate relationships do not make VewTopia a party to your transaction with a partner. All sales contracts are between you and the partner.

5. Intellectual property and content rights

All content on the Site — including articles, guides, photographs, graphics, logos, designs, layouts, and software — is owned by VewTopia or its licensors and is protected by copyright, trademark, and other intellectual property laws.

• You may view, download, and print content from the Site for your personal, non-commercial use.
• You may not reproduce, republish, distribute, modify, transmit, or create derivative works of any content without our prior written consent.
• You may not use VewTopia names, logos, or trademarks without written permission, except to identify the Site in editorial references.
• User-generated content you submit remains your property, but you grant VewTopia a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute that content in connection with the Site.
• Third-party trademarks and brand names appearing on the Site belong to their respective owners and are used for identification and editorial purposes only.

6. User conduct and prohibited activities

You agree not to use the Site to:

• Violate any applicable law, regulation, or third-party right.
• Infringe the intellectual property, privacy, or other rights of any person.
• Submit false, misleading, defamatory, harassing, or unlawful content.
• Interfere with or disrupt the Site, servers, or networks, including submitting viruses, bots, or scraping tools.
• Attempt to gain unauthorized access to any portion of the Site, other accounts, or computer systems.
• Use automated means to collect data, monitor traffic, or overload the Site.
• Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site for commercial purposes without authorization.

The Site integrates with third-party APIs and services to provide event search, hotel search, experiences, car rentals, maps, and product listings. These services are operated by independent providers under their own terms and privacy policies.

• We do not control third-party services and are not responsible for their availability, accuracy, or conduct.
• Your use of third-party services is subject to their terms, which may include additional fees, restrictions, and data practices.
• Third-party providers may change, suspend, or discontinue their services at any time, which may affect features on VewTopia.
• We may modify or discontinue integrations at any time without notice.

8. Payment and refund policies

VewTopia does not process payments for tickets, accommodations, experiences, car rentals, or products. All payments are handled by our affiliate partners. Refund, cancellation, and exchange policies are determined solely by the partner and the service provider (event organizer, hotel, tour operator, rental supplier, or merchant).

• For ticket refunds or exchanges, contact Ticketmaster or the event organizer per their policy.
• For hotel cancellations and refunds, refer to the property’s cancellation policy on Expedia.
• For experience cancellations, refer to Viator’s cancellation terms and the operator’s policy.
• For car rental cancellations, refer to DiscoverCars and the rental supplier’s terms.
• For product returns and refunds, refer to Amazon’s return policy and the seller’s terms.

If VewTopia ever offers a paid product or subscription directly, the specific terms for that offering will be disclosed at the point of purchase and will govern that transaction.

9. Disclaimers

The Site and all content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, VewTopia disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

• We do not warrant that the Site will be uninterrupted, secure, or error-free.
• We do not warrant that event, price, or availability information is accurate, current, or complete.
• Editorial content is provided for general information and entertainment only and is not professional travel, legal, financial, or safety advice.
• Any reliance on third-party listings or partner services is at your own risk.
• We do not endorse and are not responsible for the content, policies, or practices of any third-party site linked from VewTopia.

10. Limitation of liability

To the fullest extent permitted by applicable law, in no event shall VewTopia, its officers, directors, employees, affiliates, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or related to your use of the Site or any third-party service accessed through it.

• This limitation applies whether the claim is based on contract, tort (including negligence), strict liability, or any other theory.
• Our total aggregate liability for any claim arising from the Site shall not exceed the greater of (a) the amounts you paid to VewTopia in the twelve months preceding the claim, or (b) USD $100.
• You acknowledge that the limitations of liability set forth in this section are an essential basis of the bargain between the parties.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain liabilities. In those jurisdictions, the foregoing exclusions and limitations apply to the fullest extent permitted by law.

11. Indemnification

You agree to indemnify and hold harmless VewTopia and its officers, directors, employees, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, your violation of any third-party right, or your submission of unlawful or infringing content.

12. Dispute resolution and governing law

Governing law

These Terms and any dispute arising out of or related to the Site shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Informal resolution

Before filing a claim, you agree to first contact us through the contact page and attempt in good faith to resolve the dispute informally for at least 30 days.

Binding arbitration

If the dispute cannot be resolved informally, you and VewTopia agree to resolve any claim or controversy through final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring claims in small claims court if they qualify. The arbitration shall be conducted in Delaware. Judgment on the award may be entered in any court of competent jurisdiction.

Class action waiver

You and VewTopia agree that each party may bring claims against the other only on an individual basis and not as a plaintiff or class member in any class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative proceeding.

Equitable relief

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights or enforce these Terms.

13. Changes to these terms

We may revise these Terms from time to time. The “last updated” date at the top of this page indicates when the Terms were last revised. When we make material changes, we will update that date and, where appropriate, provide notice on the Site or by email. Your continued use of the Site after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the Site.

14. Termination

We may suspend or terminate your access to the Site and your account at any time, with or without cause or notice, including for violation of these Terms. Upon termination, all licenses granted to you under these Terms end. The following sections survive termination: intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution.

15. General provisions

• Entire agreement: These Terms, together with our Privacy Policy and Affiliate Disclosure, constitute the entire agreement between you and VewTopia regarding the Site.
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
• No waiver: Our failure to enforce any right or provision is not a waiver of that right or provision.
• Assignment: You may not assign or transfer these Terms without our consent; we may assign these Terms freely in connection with a merger, acquisition, or sale of assets.
• Force majeure: We are not liable for delays or failures caused by events beyond our reasonable control.
• Electronic communications: You agree that we may communicate with you electronically and that such communications satisfy any legal requirement that they be in writing.
